Short news clips in video, copyright violation or fair use?

Question in the title. How does RWJ and others use clips from everywhere, are they claiming fair use or are they just to big to mess with? I'm just curious. Thanks in advance.
 
As long as they don't claim the content as their own, and it's within a certain time frame (not sure on specifics) it's considered fair use.
 
All claim it's fair use, but that's not always the case. RWJ has been hit with several copyright strikes and his channel has been taken down a few times. Larger channels can get away with it because they're basically giving a free plug to the clip owner in exchange for usage. So if RWJ uses one of your clips, what does filing a copyright infringement case really get you? You'll have to pay for a an attorney to sue, the video where you get plugged will get taken down and you will probably feel the wrath of his fans.
