Also, if i upload something with copyright.. would i be in trouble ?

60/40 revenue split is pretty bad imo, and no you can't upload copyrighted material. If you read the Youtube rules or your network contract you could've easily found that out yourself.

i read it before i asked, now,,, wht would happen if i uploaded copyrighted material? any one try this? :p

You get a copyright strike if the original owner tells Youtube you used their material, on three strikes your monetization will be disabled for I think it was 6 months.
