QUestion about using a few second commentary clip from a sports match

Good evening youtubers,

Question I'm dong a video where I want to use clips where the commentators briefly shout goal or say the name of a soccer player.

Is this allowed even if it is NOT monetized? Probably won't have enough time to seek permission from the owner but I do plan to credit them, use less than 5 seconds worth of commentary, and not monetize the video since I'm looking to just get my channel out there

I made a video about Messi where I used about 6 seconds of commentary. The commentator shouted 'GGGOOOOAAALLL' and my video got a copyright claim from a media company. My video was monetized. However even if your vid is not monetized you'll still get a claim. I'd suggest not using the commentary.
 
Monetizing it or not won't make a difference.

Chances are, if you use commentary, ContentID will pick you up and it's source will have the option to monetize it and take all of the money it earns, block it in certain countries, or simply give you a copyright strike.

Unless you're okay with those options and willing to take the chance, it's best that you only use footage or audio that you yourself create.
 
I just wanted to amplify the comments that pointed out that it doesn't matter whether you monetize or not - content ID is a (mostly) automated system that will just check if you have anything in your video that matches what's in the database.

And regarding fair use - fair use is a legal defense. This means that to assert it, you have to be legally accused of copyright infringement first - you use fair use as a defence in court. If you're not interested, willing, or able to go to court to defend your use of copyright material, then you should not hope to rely on fair use.

Finally, please keep in mind that even if you see other videos using similar clips, it's possible their videos already have been matched via content ID, and it's also possible that there are other videos that have received copyright strikes (that you wouldn't see, because those get taken down)
 
While we are talking about this... I'm making a video (not for money) and I want to use the UEFA Champions League anthem in it.

There are a handful of videos on youtube with the song. Almost like a lyrics video. If they can get away with it, shouldn't I?

Who says they're "getting away with it"? For all you know, they may have had their videos disabled in various countries, have had UEFA issue a copyright claim, monetize the videos, and are happily collecting any income earned, or they may have simply been lucky so far. You also don't know if, or how many, other videos have been taken down already.


If you want to do things correctly, use your own content or pay (often substantial fees) to acquire the rights to use someone else's video footage, audio, or music.
