Pranks And Legality of The Video On youtube

I've Got It
I wanted to ask, what is the legality surrounding people doing pranks and social experiments and then posting it on youtube. More specifically filming people in a public place while interacting with them.

Do we need express permission after the prank from the individual(s) that was pranked that it will be in a youtube video and monetized? Would a video recording of them agreeing is fine or do I need written agreement? What would I need to cover in this agreement so I won't get in trouble in future by that individual or that they can't sue me for money made from the video.

It seems like the guy that drives around playing "THIS IS NOT A TEST. LOS ANGELES IS UNDER NUCLEAR ATTACK" to mess with people and then drive off. Or those scary pranks where the people involved run away and you might not be able to contact them. It seems unrealistic that you can get permission or even the chance to ask for permission in a lot of these. A lot of times you don't see their faces blurred as well.

I also live in California since I am aware laws are different in different countries/states.

There is not that many resources involving this type of videos. I normally do gaming videos and I am doing fine. I just want to broaden my audience a little bit with something special once a month or something.
 
As much as i know its alright if you just ask them if they're okay with being on youtube. If you film it and put it up. Like have you seen how other pranksters do? They show the pranks and do the reveals at the end telling them it was just a prank and asking if they're okay being in a youtube video. So yup.
 
It's best to ask but I doubt anyone would try and take down your video, though there's nothing stopping them.

A video agreement would be more than sufficient, as long as you have some form of proof, you're fine, I would even leave them agreeing in the uploaded video. :)
 
Talked to a few people and they say it is best/necessary to have a written agreement. A verbal agreement on camera might not be valid or protect you fully. Seems unrealistic you can get people to sign written waivers.

I dont know what to say/include in an agreement.
 
As far as I know, Many pranksters have a written out waiver that they have people sign. But most of the time these waivers are used by bigger channels. The smaller channels go by video confirmation and the really small channels sometimes do not even go by anything. If an individual was to see him/herself in a video, Youtube would simply give the uploader some time to prove that they have permission or to remove the video.
