Picture Usage Rights

Hey I found a picture that I really like and a university artist made it. I tried getting a hold of him but their forum said he hasn't been active in a long time, I want to use this picture for my YT mascot / profile pic and maybe in the banner. Is it legal for me to use it or do I need his permission?

If you gave him credit for it and let people know where it came from, it shouldn't really be a problem but then again I'm not 100% sure on any legalities. Sorry.

Absolutely need permission. Since you want to use it to represent you and your channel, it falls beyond what would be considered "fair use".

Okay thanks for the help! So that fair use, can I use a certain length of any song / movie and get away with it?

It is unlikely anything would happen, but using any logos or images that you don't fully have the rights to use doesn't make you without legal fault, and problems could definitely arise down the line.

Yeah I got ahold of the artist he was okay with it, but I decided to go a different direction. Thanks for the response!
