music in back ground of interview

Hi guys, I did an interview for my channel on sunday and there is some recognizable music being played (by the cafe we where at ) in the back ground. any one have any idea where I stand from a copyright point of view? its not really part of the action . does it mean I cant use the video or just that I cant monetize it?

If song is not copyrighted than it is alright to post a video, but if it is you will get a copyright strike. If you know the name of the song search it on youtube, look in the description and if there will be a link to buy it, then this song is copyrighted. You can try to edit your vid to make the song sound more quietly so youtube can not detect it. I hope this info is helpful.
 
unfortuneatly it looks like i will have to redo the interview in that case, as the make the song quieter , i have to make the people speaking quieter! :(

If the song is old and the group does not exist anymore even if it is copyrighted and they will send you a strike, you can disagree with it and they will not answer to you. Then after a month the strike will be removed
 
its a song I think is big atm I think sam smith .. I'm not sure of the name. If they call me on it and I take it down will anything bad other than having a strike on my name for a month happen ?

actually 1 strike isn't dangerous, 2 are serious, 3 are critical. You won't be able to monetize the video if it has something copyrighted in it, however the copyright owner will get some profit from your video. Usually youtube does not take down videos with copyrighted content in them. Copyright strike will stay even if you will delete the video and it will stay for 6 months

Your situation is fair use. If you get sued you can fight it and as long as you have proof that you were not able to control the audio in the background then it's fair use. Example when it's fair use and not fair use.

1. It's not fair use if you film the interview in a location where you can shut the music off.

2. It's fair use if you aren't the one running the audio and don't have control over the music in the background. Don't confuse this with concerts or a location where you have control over it. If you filmed at a concert knowing you did something illegal then it's your fault you recorded it. If you just showed up and did an interview at a location you couldn't get the music to be shut off then it's fair use.
 
not to worry now! I have re-filmed it and I think this was a much better interview! but good to know for future! Just waiting to hear from the person I interviewed to say they are happy! Thanks for the advice, i read so much information but none of it really seemed applicable!
 
You might have to change that music. Try using royalty free music, it`s fine to use and will not get copyrighted at all.
