Monetizing Videos with Songs that don't belong to you

Hello,

I'm a little new so I apologize. I had a quick question. I am about to upload an interview I did with someone famous in Japan and she's a singer and so I have some of her songs playing throughout the video. I do videos in Japan all the time, but the soundtracks are original. Of course, for this one, the songs are obviously not mine. Will I be able to still post the video without it getting removed if I use her songs even though I bought them on itunes? and if so will I be able to monetize it like my other videos?

Thank you so much,

Amy

You should have asked her when you did the interview

Sorry, let me clear that up:

It's Youtube's copyright policy I'm asking about since it's automated. Am I allowed to monetize videos even with the permission and/or will they get flagged even with the permission

Depends if the songs are under contentId. If they are you'll likely get a copyright strike. To be safe get written permission, state so in the description and link to a copy of permission on your blog. That's my understanding. Safer yet don't monetize or use cc music.

Thank you very much,

I'm actually fine not monetizing one video for that reason. So are you saying if I don't monetize it, then I probably won't get a copyright strike?

Buying a song on itunes or a dvd on ebay doesn't give you any rights to rebroadcast and monetize unless it specifically states so on the license you bought the media under. Otherwise anyone can buy 1000 songs on itunes and open their own music video channel.

I mean I have written permission from the artist herself but Youtube doesn't seem to care about that. I've seen people who post that everywhere in the description AND in the video itself and still get a strike.

You'll still get a copyright strike unless the artist specifically gave permission for their music to be used under a cc licence. Check under creator studios and you'll see a number of famous artists who licence their music, they have their license conditions listed. You must follow those. You can't use their other music except what they cc licenced.[DOUBLEPOST=1469758910,1469758792][/DOUBLEPOST]

She must use contentId then so the yt system will auto detect it and strike you. You then have to go through the dispute process. Is it worth it? Only you can tell.[DOUBLEPOST=1469759072][/DOUBLEPOST]To be 100% safe don't use any music not listed under cc licence on yt or the web. 2-3 strikes and you're out, not worth it for a few dollars

If you dont monetize it you may be okay if the owner of the recording (which may be her record company) either lets it go because no one but youtube is earning anything off it or they themselves monetize the video for their client.

This happened to me when I didnt even know about monetizing many years ago. I used the theme from rocky, the movie studio allowed it to stay uploaded because it was not monetized and it was unplayable in some countries all because of a song.

It was a stupid video of some friends so I took it down anyway.

I've moved this to the Copyright and Legal discussions forum. ^_^

Search for the songs through YouTube's Music Policies database (https://www.youtube.com/music_policies) to get a better idea about what happens if Content ID flags your video. Make sure to search for each song used. It will tell you if the video will be blocked by other countries, and whether or not you can monetize it for shared revenue. ^^

If it does not appear in the database, then the copyright owner can manually take down your video and give you a strike if they want. Also, the current music policies are always subject to change based on YouTube's negotiations with record labels, which is why a lot of YouTuber's are apprehensive about using Copyrighted music in their videos.
