Is it allowed to externally records part of online videos using camstudio?

I would like to use parts of other people's videos and I would like to know if externally recording the video using a camcorder or CamStudio while also including parts of the website will be considered copyright infringement or will it require consent from the original author.

Please note that even if I need to also capture sound, the videos do not contain music but only speech.

This is how a snapshot of a video should look like:

Not exactly against the rules if you make it transformation just makes you look lazy however.

If you need videos use a website that lets you download videos to get an MP4 File.

I didn't really understand this part - what transformation are you referring to?

I am not lazy, in fact, it's easier for me to download the mp4 and just cut the part I'm interested in but I'm doing it this way for 2 reasons:

The first one is the copyright concern and the 2nd is that I want to show the video was originated from various websites. In my screenshot example, I've used youtube but I might grab my videos from cnn or maybe bbc.

Bottomline, the final video will be posted on youtube so my question is: Is this practice against youtube terms?

I've seen this done for several other videos on youtube but not really sure if they're still up because nobody reported them yet or there is just nothing wrong.
 
It depends on the context of the video. For example if you are making a Video Game review and need footage of said "game" from another Youtuber since you don't have it yourself and then proceed to credit said "Youtuber" with text somewhere on the screen(and also only use what you need) then I believe it would fall under Fair Use. I've seen that practice done many times.

However if you just copy and paste said material without any alteration then yeah....it would infringe upon someone else's copyright. That's what @DigiBox is saying. The finished production would have to "transform" the part of the video you're using in order for it to be "Fair Use."
 
Hiya Matt. No you can't - is the best answer to assume to be correct. Oh and don't assume because you might see other YouTubers doing it that its allowed. There is something called 'fair use' i think which applies to America only, where you can show a few seconds (a clip) of say a movie or something. Even they can take issue with you as that is a grey area. Copyright & intellectually property is a vast field to learn. Which would take more effort than to just get on and make your own original stuff. You would likely get Strikes on your channel pretty quickly which either means you have to take down the video or allow monetisation to go to the originator of the work (if the author offers you that option). Or you would have your channel banned. You don't want that as your not allowed to make another channel ever again. That covers Youtube anyway. That's the least of your concerns.. someone could easily take legal action against you.. people take copyright quite seriously. Also and more importantly - Is there any point having a channel at all for those not planning on making their own original content? Hope some of that might be useful anyway.
 
The safest answer is simple- do you either create or have the necessary (written) permissions to use every element in your video? If the answer is no, you can expect a 3rd party claim or a strike.

Do yourself a favor and read up on the 4 points of Fair Use, but understand that only a court can rule if something is Fair Use or not...so, if you’re not willing to accept a copyright strike or go to court to fight it, don’t use anything you don’t have the rights to.

Grab videos from CNN or BBC? Be prepared for Content ID to flag your video the moment it’s uploaded.
 
if anyone took any of my video or parts of my video no matter how it was captured and used it without my permission I would have a problem with that and if I saw it I would certainly report it.

I think you missed the point of the taking the easy way out comment,
the easy way out is not just downloading the mp4 its using something someone else has created without first gaining permission to use it.
