How are people getting away with monetizing content that isn't theirs?

There was a post earlier in the week titled "How did this guy do it?" In which the OP talks about how this YouTuber is getting so many views without tags or captions.

BUT my question is, how is this guy able to monetize his videos while using other peoples content?

I've had videos flagged for monetization because the TV was on in the background but somehow this guy is able to not only post content from major networks but also monetize them.

I see bigger YouTube stars play clips from hit songs in their videos but I can't.

It's just a matter of time till he gets busted. As for bigger stars on youtube they are all managed partners and are not scanned for content id, and are usually in the clear anyway due to fair use (or have someone working for them to manage copyright related deals). However there have been a few disputes there even among big stars, like that make up channel and the music in background lawsuit and counter lawsuit.
