Help - Someone Filing FALSE Privacy Complaints Against Me

Prank Invasion

I've Got It
This morning I received a privacy complaint regarding one of my prank videos which has NEVER happened (YT gave me the moment in the video where violation occured). I said, okay well maybe that person found my video and perhaps I forgot to get their consent since it was my first time. So, I deleted that video.

Now, later in the day I get another privacy complaint on a different video--this time I have direct permission consent to use the footage of the persona I pranked during the time where YT says I violated privacy--THEREFORE, it is clear someone is trying to get my videos removed.

What's my best move?

This is what YT emailed me:
We would like to give you an opportunity to review the content in question and remove any personal information that may be used to uniquely identify or contact the complainant.

You have 48 hours to take action on the complaint. If you remove the alleged violation from the site within the 48 hours, the complaint filed will then be closed. If the potential privacy violation remains on the site after 48 hours, the complaint will be reviewed by the YouTube Team and may be removed pursuant to our Privacy Guidelines. For content to be considered for removal, an individual must be uniquely identifiable by image, voice, full name, Social Security number, bank account number or contact information (e.g., home address, email address). Examples that would not violate our privacy guidelines include gamer tags, avatar names, and address information in which the individual is not named. We also take public interest, newsworthiness, and consent into account when determining if content should be removed for a privacy violation.

If the alleged violation is located within the video itself, you may have to remove the video completely. If someone's full name or other personal information is listed within the title, description, or tags of your video, you can edit this by going to My Videos and clicking the Edit button on the reported video. Making a video private is not an appropriate method of editing, as the status can be changed from private to public at any time. Because they can be turned off at any time, annotations are also not considered an acceptable solution.

We're committed to protecting our users and hope you understand the importance of respecting others' privacy. When uploading videos in the future, please remember not to post someone else's image or personal information without their consent. For more information, please review our Privacy Guidelines.

Obviously you must send them this person direct permission consent. I presume it is in written form so just scan it and send it. If it is not in written/electronic form you must acquire it in such form as soon as possible and send it to YouTube as attached file. May be one last option is to make short video with the person from the prank where he explains that everything is OK and upload/send it to YouTube.
If you can not do the above mentioned things I am afraid you have no other choice but to delete the video.
Just always have some appropriate written form which your prank participants could sign after the prank (if they wish to do so). It is too risky otherwise.

Thanks for the responses guys…the thing is that since this has happened 2 times in a day…one of which I have direct consent from…I know for a fact this is someone is trying to lie to YT and get my videos removed for some reason.

I tried to contact YT but because I'm not a big enough channel they won't talk to me--can you believe that? My question now is what will stop this person from falsifying another privacy complaint against me on future videos?

Because their complaint is not legitimate…I think I'm not going to remove the video and let YT investigate it and see what happens. If they do remove it--I'm driving 20 minutes to Google's headquarters here in California and demanding answers.

YouTube will stop him/her if you provide them with the written consent of the prank participant. Issuing false privacy complains is violation of the YouTube rules. They will not tolerate. But again - they need a prove first!

Thank you for the reply. The problem is there is no way to contact YT to inform them of the consent (even if I could it wouldn't matter according them)….TAKE A LOOK AT WHAT YT HAS WRITTEN IN THEIR POLICY REGARDING THIS--CAN YOU BELIEVE IT:

What if I've obtained consent from the individuals?
Unfortunately we cannot accept or review agreements granting consent before the video was uploaded. Thus, we may still have to remove your video based upon the complaint.

It is contradictory because first they say:
We also take public interest, newsworthiness, and consent into account when determining if content should be removed for a privacy violation.

Sorry I can not give you any further advice.

One last thing you can do is to go to the official YouTube forums:

productforums.google.com/forum/#!forum/youtubepartners

and/or Google+ group

plus.google.com/u/0/communities/117250843496356854304

And ask for help/advice there.

Anyway Good Luck!

Leave the video up if you want to risk it or delete it. If you're not bothered about getting a strike then leave it up and let YouTube decide whether it stays or not. YouTube is almost always on the side of the person who has allegedly had their privacy violated.

@Prank Invasion,

The best thing to do is, blur/or blacken out people's faces in the videos you have currently and the future videos you upload.

All prank channels usually blur out people's faces. Best way to avoid these complaints.

Good luck to you!

If I leave it up and they delete it I get a strike? I hadn't read that…could you point me toward exactly where it says that? Thanks a lot.[DOUBLEPOST=1390539005,1390538876][/DOUBLEPOST]

Thanks for taking the time to help me out. All the prank channels I watch do not blur unless they do not receive consent from the person being pranked (Vitaly, Jack Vale, Sam Pepper, etc.). I will however blur in the future if I don't get consent.
