If you are partnered with a network then they handle the legal stuff so you can. But if you partner with YouTube yourself then you yourself will have to go to the game publishers/developers and ask for permission. Not so hard with some games if you have a good track record. By the time you are a full partner, you should anyways.

I will never get with YouTube direct. It is too risky and much harder. Because the adsense scam can still be used.
