Game music in my game review

Steven Snow

I've Got It
Hello, I am creating a game review of Super Mario 3D World and I'd like to have music from the game playing with the video. This seems to be the standard for game reviews and from what I understand it should be fair use to use material you are critiquing, but I would like to see if anyone here knows the specifics since I don't have experience in using copyrighted material. Is using game music in this way allowed?

Nintendo in general are VERY stingy about using their games on YouTube, so just the video might do it..you'll either get it claimed or a strike.

Wait what?? I could have sworn not that long ago I heard that Nintendo became owned by some company or something where they allowed people to use their games in videos...

Nintendo isn't owned by anyone but themselves. They do have a new partnering deal with Youtubers, where they'll keep some of your revenue instead of just claiming your videos.

Pretty sure Nintendo still owns Nintendo :p
You might have heard about the licensing/whatever you want to call it agreement they were working on.[DOUBLEPOST=1401473487,1401473467][/DOUBLEPOST]

Thought that wasn't out yet?

I haven't heard of any details about it being out either, but it's progress I guess. If the OP doesn't mind not monetizing this one video, he has nothing to lose since Nintendo usually only claims the videos and doesn't straight send copyright strikes.

Thats what I was talking about. Yeah. That. What about that.

Wow thanks for all the info everyone. I guess I should have mentioned that I don't monetize, but it's not something I really think about. Anyways I hope you guys are right, if so Nintendo is free to take as much of my $0 revenue as they want. lol

Also would anyone be kind enough to explain claims and strikes. I only know that they are bad. I have never had to deal with either so far.
