I made a video in a virtual world using Five Finger Death Punch song, and I checked the TY data base first

Jekyll and Hyde
Five Finger Death Punch

Viewable everywhere except 3 countries

Monetization
You can't monetize your video

A day later I got a notice from Rico Mgt (not the original claimant) the video had been yanked and I got a strike. I sent them an email however I doubt I'll hear back. My question is how the heck can YT give me a strike for using content its own database said I could use, and is there anyway I can even contact YT about that?

you sure its a copyright strike or a third party claim? these a two different things, and if it is a third party claim then you're going to obviously get one becuase of "You can't monetize your video" and the clear statement "The copyright owner of this song may monetize your video, causing ads to appear." if it's a copyright strike then you're kind of boned, you can try to appeal it with youtube but the likely hood is that it's going to appear on your account until the times up.

this is what I got:

  • Five Finger Death Punch - Jekyll And Hyde
  • Video IDnmICWYN3Ako
  • Length3:41
  • DescriptionA SecondLife Machinima filmed entirely in Secondlife by Jackson Redstar ...
  • Claimant Rico Management
  • Claimant Email copyright3@ricomanagement.com
  • Work allegedly infringed Five Finger Death Punch

I don't monetize these. just let them do their thing and put on the ads. I shoot a ton of wedding videos in the game, so I am pretty familiar with using songs and always checking youtube database first to view any restrictions

yes but is this a "copyright strike" or a "third party claim" I cant tell because of the way it's setup

Just go to advanced settings and "features" under "channel" and what it says there. If nothing then it's not a strike.

I am pretty sure its a copyright strike

Google this company.

They have a web site but the main page is password protected. There are many complaints from YouTube creators regarding them, and a Google Transparency Report also. It may be possible to get the strike retracted, especially if it can be proven they own no copyright in the song claimed.

Did you file a DMCA Counter-Notice on the basis of the YouTube Audio Library information you found?

Hello,

I fear it will not be possible to take any action.

All the songs that are in the system are subject to YouTube policy changes.

The policies, which currently apply are:

- Monetize
- Block
- Mute (Audio only)
- Takedown

The administrator of copyrights may change at any time policies.

I hope this information can help you.

Regards.
