Copyright or Not Copyright?

So, I was thinking about upcoming "Talk Show" I could do roughly around 3-5 minutes of a gameplay trailer / cinematic blah de blah, however, If i was going to use a trailer.. that has been published on youtube already how would i go about copyright issues as I do not want to get a strike or whatever. I have seen someone do top 10 games of 14/15 using trailers and I was wondering how he does it.
