Copyright Claim for my son's Let's Play The LEGO Movie?

Hi, we had a copyright claim (from Warner Bros) after I uploaded his first part of his Let's Play LEGO Movie. They point to some of the scenes from the movie as the copyright, but I've searched on YouTube and there are lots of Let's Play LEGO Movie videos and they all have the same scenes in.

What do I do?

I would really appreciate some help on this one.

Just acknowledge the claim, all it will do is include ads in the video, nothing bad will happen as far as I've heard and seen.
 
Im sorry if this comes off harsh, but just because other people did it, doesn't mean its right.

I understand what you are saying but my point is that as far as I am aware, my son isn't doing anything wrong. It's a Let's Play of the Lego game and if it wasn't allowed I am pretty sure the gaming community would know about it and would be talking about it.

Are you sure you're not referring to Content ID claims? This seems more serious to me. The video has actually been blocked.

Are you sure you're not referring to Content ID claims? This seems more serious to me. The video has actually been blocked.

"Wasn't doing anything wrong". Technically, it is copyright infringement and they can claim the content whenever they want. It wouldn't be a mistake because they own the content. Is it a Content ID? Or did they specifically contact you?

Hi, yes, technically it is copyright. I'm not suggesting they don't own it. I am saying I think it's a mistake that they have sent me a copyright infringement notice. For them to see it as infringement they would be actively preventing people doing Let's Plays of their games and I don't think they are doing that here.

When I watch the point where they say the copyright starts it shows a scene from the movie. I'm wondering if they think I've uploaded a copy of the actual movie on YouTube? That's all I can think of. But I just watched five other Let's Plays and they all had that scene in it too.

So confusing and worrying also because this isn't about me, it's my 7 year old son who would be devastated if something happened to his channel. I feel sick :-(

One last thing. Could stamping a channel Logo on the video cause this issue? It's the first time I have done that.

Any help much appreciated.

It's not a mistake. Being the copyright owners, they can do whatever they want with the content. Yes other people are doing things illegally and their videos are still up, but you don't know their situation. They may have paid royalties or asked permission to use it. Or maybe Warner Bros. just doesn't have the manpower to take everything down. It's not your content so you can't use it without permission. Period.

I just don't see 100's of videos being up on YouTube with the same content as my sons if it is copyright infringement. It's not copyright infringement if they are okay with it, and everything I have seen suggests Warner Bros are fine with people doing Let's Plays.

If they are not OK with it then that is another matter and they are quite right to have these Let's Plays blocked.

That's fine and that is your opinion and I respect that. But mistakes are made all the time. Everything in this situation points to some kind of mistake.

It's not your content and you have no legal grounds to stand on in saying that you deserve to have your video up. You have no rights to the content within the game. If you try to fight it and get a human to look at this (if this was automated in the first place), then they will see that you have no written permission and no rights to use the work.
