Hi guys,

I recently uploaded a video which states that it includes copyrighted content from Lonely Island. My channel mainly review tech products and usually for mobile devices, I would test the speaker volume by playing videos on the internet and recording how loud it sounds. It's about 30 secs out of the 7 min+ of video. I did not enable monetizing as well.

The only editing I did on the video demo was to censor out a vulgarity.

I have read the fair use policy and would like to gather feedback on whether if I had really infringed the copyright law or used it in a fair way.

Did you ask permission before using the Gangsta Rap video? Are you reviewing or critiquing the video itself? Does your review of the phone add value to the video? Did you use the core of the video, or just a small portion in your own video?

You've satisfied the Non-Commercial Use factor of Fair Use; but if you look at the questions which follow my asking if you asked for permission, I think you will see that you haven't satisfied the other three factors and conditions for Fair Use.

I wouldn't dispute the claim if I were in your place, but allow the copyright holder to apply their policy to your video; as yes, you have infringed copyright on the video that you used if you didn't get permission before using it.
 
Ah shucks that's what I thought. I cant remove the audio since there is no option for me to do it. How can I solve this? If one day they decided to remove my video, I cant do anything about it?

You'd have to remove the entire video which is playing through the phone; just removing the audio wouldn't work in any case; the video portion of a music video is also under copyright. I doubt they will strike you at this point, and maybe never: however, you need to ask the copyright holder's permission to include any copyrighted content in a YouTube video, and if applicable, pay any necessary royalties and licensing fees before including such content in your video.
 
What I'd suggest is in the future commission a 'theme song' a little beat you can put up on your channel that you can play for all your demo purposes. It'd avoid copyright, as well as give a standard to hold all audio demos to

Youtube's free audio library would be useful for this too. There are plenty that don't require credit.
 
Sigh I admit it's my mistake but I felt their songs was nice so I used it for my demo. I'm gonna use my own videos for demo next time lol.

Can I remove the video, edit the footage to demo my own video instead, and re upload it? I read that even if I do that, I will still be flagged.

It's a pity to remove that video of mine since it garnered over 1k views. That's a lot for views for a new channel. I just don't want to be at a mercy of the copyright owner.

True enough. My train of thought is more if you use the same song in all of them people will think of you and the song together. If you get a theme song it'd be easier to relate you to your video as well as be more personalized. But the built in library would definitely work too
 
Thanks for the suggestion and I will definitely change that. My background music are all from the YouTube library which are free to use.
