can i use a bit of film?

Could I grab some help please? I'm stuck. I want to around 14 seconds of footage from a film in a video. Not normally my thing. I understand this may be allowed under fair use? But I normally only have 100% my own content creation so I've not ventured down this path before. It will be a non sponsored video with no affiliate links or anything like that. The video is educational.. its a 'how-to' type video. My Question is am I good to carry on and do that ?? Or would I likely encounter any problems? Thanks for any info
 
From my understanding of the law, at least within the U.S you are allowed to use any copyrighted material (video, photographs, logos from companies, etc) as long as the video in question falls under education. But don't forget that this video must not be monetized or commercialized.

Other then that that is all I know. I'd recommend doing some research before continuing further. Best of luck!
 
Thanks. I've been swatting up on this. I've also reduced the footage I want to 7 seconds. I think I can use the bit I want within a proper context and within the spirit of the fair use conditions. I'll try
 
More than likely, your video will then be picked up by Content ID, the studio (or proper right holder) will monetize your video on their behalf and they’ll take any money your video earns.

excuse my ignorance. I know nothing about this. But what if their channel isn't a youtube partner. If they have less than 1000 subs how can they monetize my video. And why would a movie company have a youtube channel?

Is getting picked up by Content ID a bad thing for me? Should I just not use the clip ?

That is incorrect. Copyright law applies whether you want to monetize/commercialize it or not.
 
@UhoohExtra if you can't buy it, make it or fake it.

In your position I would make the word "FILM" with big bold font and I would rolled it in post.
Faking and emulating a film strip. Actually you can do this with footage or images.
It is quite simple, there are many guides in Youtube how to achieve this.

well it appears fair use requires criteria under 4 categories to be met. I think I meets 3 1/2 of them lol. It took so damn long to study this that I could have spent the whole day doing something productive instead.. just for sake of a few seconds clip i wanted to use. I decided now its just not worth the hassle so I'm gonna leave out as I don't like hassle. Thanks for all responces though!
