Well, if they have a set date stating when they have to pay you and don't pay you then. Possibly. Are you sure you have checked your contract though? You may have a threshold which means you only get paid on a particular date when you reach that threshold. If there isn't one, try get in touch with your partner manager and just talk about you being unhappy at breaking your contract.

Contracts only mean something if you are willing to sue. A big expensive lawyer told me that. Breaching a contract isn't illegal in any state in the United States of America.
So, that being said if Machinima has the lawyers to go to court over contract breach "damages" and your contract is worth the fight they will do it. If you're not worth it you can just break it and they most likely wont chase you.
