I've been looking everywhere for the answer to this question so if you can answer it I will love you forever. Okay, not forever, but like...maybe 3 days.

What is the deal with gaming networks and copyrighted content? I was told most networks don't have any sort of copyright licensing hookup, so in theory it's no different than uploading copyrighted content without partnering with a network. If that's true then how are there so many huge channels uploading so much copyrighted content monetizing their views without getting taken down/sued by the copyright holders? Is it really just that non-youtube networks don't do copyright checks on the videos you monetize and copyright holders don't bother to do anything about it?
 
Almost all gamers network or no network work under fair use. Networks give a lot of people a false sense of security, but it does not give you any legal help. However, directly under Adsense, you can get your account disabled for gaming very quickly. With a network, you don't have that problem. Some of the largest channels do however reach out to developers to get permission to upload. As long as you have related commentary, it should fall under fair use.
 
I really think that a lot of game publishers are wising up and realizing that "Lets Plays" and other such gaming content is basically free advertising. If a game is popular on YT, that drives sales.

I feel that's why so many turn a blind eye to it.

True, but they also don't have the time or care to take it down. It is free advertising, but they would not stop YouTubers even if it wasn't. It is fair use, and game companies have no legal right to remove content unless it is in the ToS of the game that you cannot use the game for monetized video content.
 
They just don't care(well most of them). It's all free advertising and most game developers understand this drives sales.
 
Wow so, they really all operate on fair use? That's actually a bit surprising. With the murky nature of fair use, any one of them could be a target to a strategic lawsuit with all the money some of those big names have made.

Also, what about all the channels that just do walkthroughs (i.e., just playing the game, with no commentary)? I just got done watching an entire Resident Evil 4 walkthrough and every episode was monetized.

At any rate, let me know if I'm right about this: In general, the reason people join networks is to be able to 1) take advantage of their community for extra views and subs, and 2) monetize their videos with ads (operating under a fair use theory, assuming they do commentary) without worrying about youtube's paranoia. Right?

I do no commentary(with cut scenes) walkthrough's and all my video's are monetized. Never had any issue with content id(i got content id matches but that was before partnering). I think this depends on the game developers and the network you are in. I know TGN allows you to upload gaming video's without commentary.

That kind of blows my mind. Well, maybe it'll be easier to monetize a gaming channel than I thought (assuming I can actually get my channel popular...). I guess since I have you here though, I'll just ask you generally: are you happy with TGN?

Yeah, i'm very happy! Partnered with them for 1 year and 4 months. Never had problems:)
