Can you find a similar piece of music from a smaller artist and contact them? Or is the video based on that song?
hmmm...I don't think so. The video is based on the song :/

I'd just go for it, see what happens.
In the worst case Russia invades US and demends the video will be taken offline that very same moment.
Nothing will happen, if you get a copyright warning delete the video, that's all.
You're free again.

Even if you get a strike for the video you can still be a partner since the strike will be removed after 6 months (in case you don't get another one of course). That's what I read.

Please read up on Copyright laws AND consult a lawyer.

Most of the information people are giving in this forum regarding copyright is FALSE.

You should seriously do some research before trying to "help" other's out.
You may think you are doing them a favor, when in actuality, you are doing more harm than good.

The ONLY way you can use material for commercial use is if you have EXPLICIT, WRITTEN consent from the artist, the label, the manager, or whoever OWNS the material.

And as far as "Fair Use" goes, you should consult a lawyer to make sure you are on solid ground.

Sure you may be able to put a vid up with Copyrighted music and not get caught...but if you DO get caught, you are jeopardizing all of your hard work and perhaps legal action.

There are many great places online to get royalty free music for free.
http://www.incompetech.com is one

And there are other great places to purchase music for use for a fair price:
http://www.themusicbed.com/
http://www.stockmusic.com/
http://www.jewelbeat.com/
http://www.premiumbeat.com

And MANY MANY MORE.

Just MAKE SURE YOU READ THEIR TERMS OF SERVICE!! Some have restrictive licenses even though you are paying for them.

If you really, really want to make a video using the newest Lil' Wayne song, then you need to contact the label and be ready to spend several thousand dollars for rights to the track.

If you get a gut feeling that "This might be wrong" or "I wonder if I should do this" You are probably right! YOU SHOULDN'T DO IT.

Don't consult random forums and get some random info from some unknown person....
Be smart guys, consult professionals like copyright lawyers for advice on things like this.

Copyright is a big deal and should not be taken lightly.
Would you want someone to steal your music or copy your video and make money off of it, while you get nothing?
I didn't think so....

**NOTE: I over reacted here. A lesson for me in trying to maintain my cool while going thorough a rough time. I was going to edit it (I feel like a turd), but then it would throw the whole flow of the conversation out of whack. It's all good now. I just wanted to admit I was a bit turdish. :) **

Maybe YOU should do some research. Try using something besides Wikipedia too.

http://fairuse.stanford.edu/Copyright_and_Fair_Use_Overview/chapter9/9-c.html

Read it. Also use Google. How about reading supreme court rulings on the issue too.

Here's some more reading for you. http://apps.americanbar.org/litigation/committees/intellectual/roundtables/0506_outline.pdf

You are right though. Talk to a damned lawyer. I am not a lawyer. I do, however, know what I'm talking about.

One more. Just for the hell of it. Happy reading. http://www.centerforsocialmedia.org/fair-use/related-materials/codes/code-best-practices-fair-use-online-video

ROFLS, I said consult a lawyer and nothing else.

I don't know why you are being so defensive.
This post was not directed towards you, it was directed to the community as a whole, as MOST of the posts regarding Copyright are completely wrong and encourage stealing even more.

Just because you might not get caught doesn't mean you should do it.

I know the laws, I know the codes and one of my best friends is a copyright lawyer, so yes, I know what I'm talking about.
And YES, the best advice I can give is:
- Always consult a Lawyer who is licensed to handle these sort of things.
- Always get permission.
- If it feels wrong, it most likely is.

I want to see the community grow.
Chill out, bro!

I apologize. I've had a bad day. Dealing with the suicide of a good friend. Not an excuse... but I've been on edge...

I was defensive though, because it appeared as though you were being combative. The large type. The tone. lol I don't know. I just felt the need to recoil. I usually don't do that. But (while not an expert) I feel I can offer valid advice. That's all it is too. Advice.

I know all of this because I've researched it extensively. I've also worked in radio production rooms voicing and piecing together spots, held on air positions, and worked in radio sales writing copy. I've seen/dealt with copyright issues for quite some time.

I'm also OCD... and have spent way too many a night obsessing over this (and a whole host of other crap). lol

You are definitely right though.

No matter what people tell you, even if the person has done their research, it's best to talk to a lawyer. We all know one. Call 'em. Facebook 'em. Something. Speak with someone with esq. after their name.

Advice offered here, in an unofficial forum, is take at your own risk.

Copyright law is interesting, because of how fluid the subject is. It's quite static. Some cases are open and shut, and other, almost identical cases aren't so easy to read.

Definitely talk to a lawyer though. Always a good decision.

Once again, I apologize for being abrasive. I'm off to the liquor cabinet for a stiff drink.
