Where do they get the footage?

Here are just a few of dozens examples: one, two, three. All of these videos use footage of new upcoming games, but where do they get this footage if not from youtube? I have tried searching and sometimes even press kits include only links to youtube videos.

How do they get that footage without violating 5.A of Terms of Service: "You shall not download any Content unless you see a “download” or similar link displayed by YouTube on the Service for that Content."?

Probably from the PR companies. Those sites had a lot of subscribers. If the games have been announced you could probably write to the companies for permission to use PR clips in your videos. Most companies have a list of "press" that they distribute this kind of content to.
